Terms of Service

These terms are the agreement between you and Eclipse Studio about your use of Orbita. We have tried to write them in plain language. Using Orbita means you accept them.

What Orbita is

Orbita is a subscription service for saving, organising, and finding things: links, notes, photos, tasks, and events. It is available as a mobile app, a web app, and a browser extension. We add and change features over time.

Your account

You need an account to use Orbita, and you must be at least 13 years old. You are responsible for keeping your login details secure and for what happens under your account. Tell us at privacy@useorbita.app if you think someone else has access to it.

Give us accurate information when you sign up. Do not impersonate anyone else or share your account with people it was not issued to.

Subscription and billing

Orbita requires a paid subscription. There is no free tier. Current pricing:

• $2.99 for your first month, as an introductory offer for new subscribers on the monthly plan.
• $12.99 per month after the introductory month.
• $99.99 per year if you choose the annual plan, which works out to about $8.33 a month.

Your subscription renews automatically at the end of each billing period, at the standard rate for your plan, until you cancel. Your account is charged through the app store you subscribed with within 24 hours of the period ending.

You can cancel any time in your Apple or Google account settings. Cancelling stops the next renewal; it does not refund the period you are currently in, and you keep access until that period ends. Deleting the app does not cancel a subscription.

Refunds are handled by the app store that took your payment, under its policy, not by us. If we change our prices, we will tell you before the change affects you, and you can cancel if you do not want to continue.

What you save stays yours

You keep all rights to the things you save in Orbita. We do not claim ownership of your content.

To actually run the service, we need your permission to do specific things with it: store it, back it up, display it back to you, show it to people you have shared a space with, and send it for AI analysis as described in our Privacy Policy. That permission exists only to operate Orbita for you, and it ends when you delete the content or your account. We do not use your content to market anything, and we do not sell it.

What you may not do

Do not use Orbita to:

• break the law, or help anyone else break it;
• save or share material you have no right to, including other people’s copyrighted work;
• store sexual content involving minors, or content that promotes violence or hatred against people;
• harass, threaten, or invade the privacy of another person;
• attack the service: scrape it, overload it, probe it for weaknesses, or work around rate limits or access controls;
• resell Orbita, or use it to build a competing product from our data.

If you find a security flaw, please report it to privacy@useorbita.app rather than exploiting it. We will not pursue people who report problems in good faith and give us a fair chance to fix them.

Content from other sites

Orbita saves things from around the web, and to show you a useful preview we store copies of some of it, such as a post’s image. That material belongs to whoever made it, and saving something into Orbita does not give you any rights to it that you did not already have. What you may do with it is governed by the original source’s terms and by copyright law.

Copyright complaints

If you believe something stored in Orbita infringes your copyright, email privacy@useorbita.app with a description of the work, where it is in Orbita, and your contact details. We will review it and remove material where the complaint is valid. We may remove content and terminate accounts of repeat infringers.

About the AI

Orbita uses AI to read what you save and suggest a title, tags, and where it belongs. It gets things wrong. Some of what it produces is an outright guess. Estimated nutrition figures for a recipe are the clearest example.

Availability

We aim to keep Orbita running and your data intact, but we do not guarantee it will be uninterrupted or error-free. We may change, suspend, or stop parts of it. If we discontinue the service altogether, we will give you reasonable notice and a way to export what you have saved.

Keep your own copies of anything you cannot afford to lose. Orbita is not a backup service.

Ending things

You can stop using Orbita whenever you like and delete your account from Settings. See the Privacy Policy for what deletion does and does not remove.

We may suspend or close your account if you materially breach these terms, or if we are required to by law. Except where the breach is serious or we have no lawful choice, we will warn you first and give you a chance to put it right. If we close your account without cause, we will refund the unused part of what you have paid.

Disclaimers and liability

Orbita is provided “as is”. To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent the law allows, we are not liable for indirect, incidental, or consequential loss, or for lost profits or lost data. Our total liability to you for any claim is limited to what you paid us in the twelve months before the claim.

Changes to these terms

We may update these terms. If a change matters, we will tell you in the app or by email before it takes effect, rather than quietly editing this page. Continuing to use Orbita after a change means you accept the new terms. If you do not, you can cancel and delete your account.

Governing law

These terms are governed by the laws of the State of Nevada, USA, and the courts of that state have jurisdiction over any dispute. This does not deprive you of the protection of mandatory consumer law in your country of residence.
